PopCal Technologies LLC (“PopCal,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy describes the information we collect, how we use it, and your rights when using our websites, applications, and services (“Services”). By using the Services, you agree to this Privacy Policy. Undefined capitalized terms have the meanings given to them in the PopCal Terms of Service.
1. Information We Collect
We collect personal information including name, email, phone number, mailing address, account credentials (email, password, optional two-factor authentication), payment details provided via our payment processor (card type, last four digits, expiration date, billing address, and transaction metadata), IP addresses, session cookies, and system logs. For minor End Users, we collect similar information (name, email, phone, birthday, IP address, signatures) only when authorized by a parent, legal guardian, or authorized school representative. You may also send or receive communications through the Services, including SMS or email messages between Customers and End Users.
2. How We Use Information
We use the information we collect to provide, maintain, and improve the Services; process payments and manage billing; authenticate accounts and secure access; send transactional notifications such as payment confirmations and scheduling updates; support business communications between Customers and End Users; and comply with legal obligations and enforce our Terms of Service. We do not sell or rent personal information.
3. Sharing of Information
We share personal information only as needed to provide the Services, including with payment processors, messaging and email delivery providers, accounting platforms, cloud infrastructure providers, and analytics tools, all under confidentiality and security obligations. A current list of subprocessors may be requested by contacting us.
4. Cookies and Tracking
We use session cookies to authenticate logins and maintain user sessions. We also log IP addresses and basic usage data for security, troubleshooting, and analytics. Most browsers allow you to disable cookies, but some features of the Services may not function properly if cookies are disabled.
5. Children’s Privacy
PopCal does not knowingly allow children under the age of 13 to create accounts without verified parental, guardian, or authorized school representative consent. Customers are responsible for ensuring any minor End User’s information is collected and shared in compliance with applicable law, including obtaining and maintaining necessary consent.
6. Data Storage and Security
All personal information is stored and processed on secure cloud infrastructure with industry-standard encryption and access controls. We implement reasonable administrative, technical, and physical safeguards to protect your data, but no method of transmission or storage is 100% secure.
7. Data Retention
We retain personal information as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. Customers may request deletion of End User data in accordance with applicable law and our Terms of Service.
8. Your Rights
Depending on your location, you may have rights to access, correct, delete, or restrict the processing of your personal information. To exercise these rights, contact us at the email below and we will respond in accordance with applicable law.
9. International Users
PopCal is based in the United States but may serve users in other countries. By using the Services from outside the U.S., you consent to the transfer and processing of your information in the United States, where data protection laws may differ from those in your country. If you are located in the European Economic Area or another region with data protection laws, you may have rights under applicable law to access, correct, delete, or restrict the processing of your personal information. PopCal will respond to such requests in accordance with applicable law and within our role as a service provider processing data on behalf of our Customers. Customers are solely responsible for ensuring their use of the Services and their collection and control of End User data complies with applicable laws, including obtaining and maintaining any required consents under regulations such as the GDPR.
10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email or through the Services. The updated Policy is effective as of the date posted.
